2. WEBSITE TERMS OF USE

By accessing propertyjunk.com, using our online booking system, or engaging our services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please exit our website immediately.

Property Junk grants you a limited, non-exclusive, non-transferable license to use our website for personal or business purposes related to our junk removal services. You may not:

3. FLORIDA CONSUMER PROTECTION NOTICE
⚠️ IMPORTANT: YOU HAVE THE RIGHT TO CANCEL THIS CONTRACT WITHIN 3 BUSINESS DAYS
FLORIDA COOLING-OFF PERIOD (Required by Florida Law)
You, the Customer, may cancel any service contract by notifying Property Junk in writing before midnight of the third business day after signing this agreement.

If you cancel within 3 business days:
- Full refund within 20 days of cancellation notice
- No cancellation fees charged
- Services already performed charged at standard rates
This cancellation right applies to:
- Contracts for future/continuing services
- Services sold at your residence or non-permanent business locations
- Service contracts over $25
4. SERVICE TERMS & CONDITIONS
4.1 Services Provided
Property Junk provides junk removal and waste management services including:
- Household furniture and appliance removal
- Construction and demolition debris (non-hazardous)
- Yard waste and organic material removal
- Office cleanouts and commercial junk removal
- Electronic waste disposal (to certified facilities)
4.2 PROHIBITED ITEMS - FLORIDA LAW COMPLIANCE
WE DO NOT REMOVE:
- Hazardous Materials: Paint, chemicals, solvents, pesticides, automotive fluids
- Medical Waste: Pharmaceuticals, needles, medical equipment, biological materials
- Toxic Substances: Asbestos, lead-based materials, PCBs
- Explosives: Fireworks, ammunition, compressed gas cylinders
- Electronic Hazardous Components: CRT monitors, old televisions with lead
- Items requiring special disposal under Florida DEP regulations

4.3 Service Limitations
- Maximum single item weight: 200 pounds
- Items requiring special equipment incur additional charges
- Structural removal requires separate agreement
- Access must be clear and safe for our crew
5. PRICING & PAYMENT
5.1 Pricing Structure
- Minimum Charge: $125 per service call
- Volume-Based Pricing: Based on truck space utilized
- Weight Surcharges: Items over 100 pounds
- Special Disposal Fees: Items requiring certified disposal facilities
5.2 Florida Sales Tax Compliance
Florida sales tax will be added to all services as required by the Florida Department of Revenue.
5.3 Payment Terms
- Payment Due: Upon service completion
- Accepted Methods: Cash, check, credit card, digital payments
- Late Payment: 1.5% monthly fee on unpaid balances over 30 days
Cancellation Fees:
- 24+ hours notice: No charge
- Same-day cancellation: $50
- No-show fee: $75
6. CUSTOMER RESPONSIBILITIES
6.1 Property Access Authorization
Customer warrants:
- Legal authority to grant property access under Florida Statute § 83.53
- All tenants, lessees, and occupants have consented to our access
- Access limited to areas designated for junk removal
- Property conditions documented before service
6.2 Item Preparation
- Items must be accessible and separated from items to keep
- Customer removes personal valuables before service
- Electrical disconnection of appliances (customer responsibility)
- Clear communication of items for removal vs. items to keep
6.3 Customer Certifications
Customer certifies:
- Ownership or legal authority to dispose of all items
- No liens, mortgages, or third-party claims on items
- No hazardous materials present (see prohibited items list)
- Compliance with municipal permit requirements
7. FLORIDA ENVIRONMENTAL LIABILITY PROTECTION
7.1 Customer Environmental Certification
Customer certifies under penalty of perjury that all items contain NO hazardous materials as defined by Florida Administrative Code Chapter 62-730.
7.2 Environmental Liability Transfer
If hazardous materials are discovered during service:
- Immediate Work Stoppage for safety evaluation
- Customer Liability for all environmental assessment costs
- Customer assumes ALL liability for:
- Florida DEP fines and penalties (up to $50,000/day)
- Environmental cleanup and remediation costs
- Third-party injury or property damage claims
- Legal fees and regulatory compliance costs
7.3 Emergency Procedures
Property Junk reserves the right to evacuate premises and contact Florida DEP if hazardous materials pose immediate safety risks.
8. LIABILITY LIMITATIONS
8.1 Florida-Compliant Liability Cap
Property Junk's total liability for any claim is LIMITED to the lesser of:
- $500 per incident, OR
- The amount paid for services giving rise to the claim
8.2 Exclusions from Liability
We are NOT liable for:
- Pre-existing property conditions or damage
- Items with hidden defects or structural weakness
- Normal wear and tear from moving large items
- Damage to landscaping, driveways, or walkways from necessary equipment access
- Items accidentally removed if not properly separated
- Consequential, incidental, or punitive damages
8.3 Property Damage Claims
- Claims must be reported within 24 hours of service
- Items become Property Junk's property once loaded
- Pre-service property documentation required for claims
9. CONSTRUCTION LIEN RIGHTS (Florida Chapter 713)
9.1 Lien Rights Reserved
For construction, renovation, or improvement projects, Property Junk reserves statutory lien rights under Florida Chapter 713 for unpaid services.
9.2 Lien Procedures
- Notice to Owner may be served per Florida Statute § 713.06
- Liens may be filed against property for unpaid balances
- Payment terms: Net 30 days to avoid lien filing
- Conditional lien waiver provided within 10 days of full payment
10. MUNICIPAL PERMIT COMPLIANCE
10.1 Permit Requirements
- Customer responsible for obtaining required municipal permits
- Customer warrants all necessary approvals are in place
- Service may be suspended if permits are invalid
10.2 Violation Liability
Customer assumes liability for:
- Municipal fines or penalties for unpermitted work
- Code enforcement violations or stop-work orders
- Regulatory compliance costs or delays
11. INDEMNIFICATION
Customer agrees to INDEMNIFY AND HOLD HARMLESS Property Junk from claims arising from:
- Misrepresentation of item ownership or disposal authority
- Presence of undisclosed hazardous materials
- Property damage from customer's failure to follow instructions
- Third-party claims related to removed items
- Municipal permit violations or regulatory non-compliance
- Worker misclassification claims involving customer control over our workers
12. FLORIDA DECEPTIVE TRADE PRACTICES COMPLIANCE (FDUTPA)
12.1 Truth in Advertising
Property Junk warrants that all service descriptions, pricing, and capabilities are accurate and complete as of booking date.
12.2 Pricing Transparency
- Written estimates are binding unless customer changes scope
- Additional charges require customer consent
- All fees, taxes, and surcharges disclosed upfront
- No hidden costs or bait-and-switch pricing
12.3 Customer Acknowledgment
By booking services, customer acknowledges receiving complete information about services, pricing, limitations, and rights under Florida law.
13. DISPUTE RESOLUTION - FLORIDA ARBITRATION COMPLIANCE
13.1 Mandatory Arbitration
All disputes SHALL BE RESOLVED through binding arbitration under Florida Arbitration Code (Chapter 682).
13.2 Non-Waivable Rights (Florida Statute § 682)
- Right to legal representation
- Neutral arbitrator disclosure requirements
- Florida court jurisdiction for enforcement
- Subpoena and discovery powers
- Provisional remedy availability
13.3 Arbitration Process

14. ELECTRONIC SIGNATURE COMPLIANCE (Florida UETA)
14.1 Electronic Transaction Consent
By clicking "Accept," "Agree," or similar buttons, customer:
- Demonstrates clear intent to be legally bound
- Consents to conducting transactions electronically
- Acknowledges electronic signature validity under Florida UETA
14.2 Security & Records
Property Junk maintains electronic records including timestamps, IP addresses, and authentication measures per Florida record retention requirements.
15. PRIVACY & DATA PROTECTION
15.1 Information Collection
We collect contact information, service addresses, payment data, and website usage information necessary for service delivery and business operations.

17. FLORIDA INSURANCE & LICENSING COMPLIANCE

- Sales tax permit (Florida Department of Revenue)
17.2 Insurance Coverage
We maintain insurance as required by Florida law:
- General liability insurance ($1,000,000 minimum)
- Commercial vehicle insurance
- Workers' compensation (if applicable)
- Certificate of insurance available upon request
18. SUBCONTRACTOR RELATIONSHIP CLARIFICATION
18.1 Independent Contractor Status
Any subcontractors used by Property Junk are independent contractors, not employees of customer.
18.2 No Joint Employer Relationship
Customer disclaims joint employer relationship with Property Junk's workers or subcontractors and may not exercise day-to-day control over our workers.
19. FORCE MAJEURE
Property Junk is not liable for delays or cancellations due to:
- Weather conditions affecting safe operation
- Equipment breakdowns or mechanical failures
- Traffic, road conditions, or infrastructure issues
- Government restrictions, regulations, or emergency orders
- Acts of God, natural disasters, or circumstances beyond our control
20. MODIFICATION & ASSIGNMENT
20.1 Terms Modification
Property Junk may modify these Terms with 30 days notice posted on propertyjunk.com. Continued use constitutes acceptance of modified terms.
20.2 Assignment Rights
Customer may not assign this agreement. Property Junk may assign to affiliates, successors, or business purchasers.
21. SEVERABILITY & GOVERNING LAW
21.1 Severability
If any provision is unenforceable, remaining provisions remain in full effect. Invalid provisions will be replaced with similar enforceable terms.
21.2 Governing Law
This agreement is governed by Florida state law. Court proceedings, if necessary, shall be in Alachua County, Florida.
21.3 Entire Agreement
These Terms, together with our Privacy Policy, constitute the complete agreement between parties, superseding all prior understandings.

- Agreement to all provisions including arbitration and liability limitations

- Authorization for Property Junk to perform requested services
- Confirmation of legal authority to dispose of all items
- Understanding of environmental liability for hazardous materials
- Acceptance of municipal permit responsibilities
Electronic Signature Acknowledgment:
Customer's electronic acceptance constitutes a legally binding signature under Florida UETA.
